Weston Insurance Declared Insolvent – FAQ’s

NOTE: If you are a Worthen Insurance Group client with a Weston policy, we have already started writing a replacement policy for you.  We will call you when complete and you’ll receive your new policy documents by email. We will call you as soon as your replacement policy is issued. This will be complete within the next couple of weeks.

Weston Insurance was an ADMITTED CARRIER in Texas, therefore Weston policies are covered by the state guaranty association until September 7, 2022, when we must have everyone moved to a new carrier.

So far in 2022, 7 carriers operating in Texas have been declared insolvent, had their financial stability rating downgraded, or left the state of Texas. Those carriers are:

  1. Weston
  2. Lighthouse
  3. GeoVera
  4. FedNat
  5. Maison
  6. Centauri
  7. Occidental

Additionally, many other carriers have stopped writing new policies in Texas completely and are not accepting new business right now.

FAQ’s

REFUNDS

When will I get my refund? The Guaranty Association will take over paying out claims as well as processing policy refunds. You are expected to receive your refund within 60- 90 days.

Once all policies are canceled (September 7), the calculation of unearned premium amounts due to policyholders will be performed. Once completed, the information will be sent to state guaranty associations for the processing and payment of unearned premium. The process will take approximately 30 to 60 days after September 7, 2022. This time is required to correctly calculate the unearned premium amounts, transmit the data to state guaranty associations, and allow the time necessary to process, print, and mail checks.

CLAIMS

CLAIMS FOR LOSSES INCURRED PRIOR TO 12:01 A.M. ON September 7, 2022: There is a process in place for payment of covered claims incurred before 12:01 a.m. on September 7, 2022. Your state’s insurance guaranty association was activated to pay outstanding Weston claims, subject to certain statutory conditions and limits. The processing and payment of pending covered claims will be made by the applicable state insurance guaranty association, subject to any applicable caps and statutory exemptions.

The deadline for filing claims in the Weston receivership proceeding is August 8, 2023.

  • Information regarding the method for filing a claim in the receivership proceeding will be available on the SDR’s web site: www.weston-ins-liquidation.com.
  • PROCESS FOR PAYMENT OF CLAIMS: The SDR is currently gathering claim files and claim data to forward to your state’s insurance guaranty association. As a result, there may be a slight delay in claim processing during this transitional period. Please continue to contact Weston using the contact information below to check the status of an existing claim and/or to file a new claim. The SDR’s web site, www.weston-ins-liquidation.com, will be updated once the transition is completed.
  • CONSUMER/CLAIMS CALLSConsumers with questions regarding Weston should contact the Company directly at Claims/Customer Service: (877) 505-3040.
